TERMS AND CONDITIONS

Adobea Ventures, LLC (dba Experience Ghana Travel and Tour Co.)

1. Agreement

By booking with Experience Ghana Travel and Tour Co., you ("Guest") agree to the following Terms and Conditions in full. These terms constitute a binding agreement between you and Adobea Ventures, LLC (dba Experience Ghana Travel and Tour Co.) ("Experience Ghana," "we," "us," or "our").

2. Payment

Full payment is required to secure your spot. All payments are subject to a processing and transaction fee of up to 5%, which is non-refundable under all circumstances. The initial deposit paid at the time of booking is non-refundable under all circumstances, regardless of when a cancellation request is submitted.

3. Cancellation & Refund Policy

All cancellation requests must be submitted in writing to contact@experiencegh.com. The date of receipt of written notice determines eligibility. The initial deposit is non-refundable under all circumstances and will not be returned regardless of when a cancellation request is submitted.

More than 120 days before the trip start date (before August 29, 2026): Guests are eligible for a refund of all payments made beyond the initial deposit, minus applicable processing and transaction fees of up to 5%. The initial deposit will not be refunded.

Between 120 and 90 days before the trip start date (August 29, 2026 to September 28, 2026): Guests are eligible for a 50% partial refund of all payments made beyond the initial deposit, minus applicable processing and transaction fees of up to 5%. The initial deposit will not be refunded.

90 days or fewer before the trip start date (on or after September 28, 2026): No refund will be issued and all payments, including the initial deposit, are forfeited.

No exceptions will be made to this policy, including for medical emergencies, flight cancellations, visa denials, or personal circumstances. Guests are strongly encouraged to purchase independent travel insurance.

4. Guest Transfers

A Guest may transfer their booking to another eligible individual provided written notice is submitted to contact@experiencegh.com and all required documentation for the incoming Guest is completed no fewer than 45 days prior to the trip start date (by November 12, 2026). The incoming Guest must complete all required documentation before the transfer is considered confirmed. No transfers are permitted within 45 days of the trip start date (on or after November 12, 2026). Experience Ghana does not offer trip credits or transfers to future trips under any circumstances.

5. Cancellation by Experience Ghana

In the rare event that Experience Ghana cancels the trip, Guests will receive a full refund of all amounts paid, minus applicable processing and transaction fees of up to 5%. Experience Ghana's liability is limited solely to the refund of payments made and does not extend to any additional costs incurred by the Guest, including but not limited to flights, accommodations booked independently, or visa fees.

6. Force Majeure

Experience Ghana shall not be liable for any cancellation, delay, modification, or failure to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government-imposed travel restrictions or bans, strikes, or any other event outside of Experience Ghana's control ("Force Majeure Event"). In the event of a Force Majeure cancellation, Experience Ghana will make reasonable efforts to issue partial or full refunds at its sole discretion, but is not obligated to do so.

7. Liability Waiver

By booking with Experience Ghana, the Guest acknowledges and agrees that Experience Ghana, its organizers, guides, employees, and affiliates are not liable for any injury, illness, loss, theft, damage, or death occurring during the trip. Experience Ghana is not responsible for the acts or omissions of third-party vendors, including hotels, transportation providers, event organizers, or activity operators. Guests participate in all activities at their own risk. Experience Ghana strongly recommends that all Guests obtain comprehensive travel insurance prior to departure, covering medical emergencies, trip cancellation, and loss of personal belongings.

8. Third-Party Events & Activities

Certain activities on the itinerary, including the AfroFuture Festival, are operated by independent third parties and are subject to change, cancellation, or modification without notice. Experience Ghana is not liable for changes to third-party events and no refunds will be issued on that basis. Some activities are listed as optional and are at the Guest's own expense.

9. Travel Documents & Requirements

Guests are solely responsible for ensuring they hold valid travel documents, including passports, visas, and vaccination records (including Yellow Fever certification as required for entry into Ghana). Experience Ghana is not liable for any Guest's failure to obtain required documentation and no refunds will be issued on this basis.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of the State of New York.

11. Add-On Experiences

Guests who wish to participate in optional add-on experiences must submit payment in full and confirm their participation no fewer than 30 days prior to the trip start date (by November 27, 2026). Add-on selections and payments submitted after this deadline will not be accepted and Experience Ghana cannot guarantee availability. Add-on fees are non-refundable once confirmed.
