PLEASE NOTE: In the event you are separated from the tour group due to your own actions you will be solely responsible for finding your way to the next stop on the tour (at your own expense.) Understand that you may miss a culinary tasting experience provided while on the bus to the next tour stop. We will be awaiting your return to the group at the next culinary stop.
By virtue of participating in the food tours, culinary events and any activity offered by Wow Events Designs (the "Company") and any of its sister companies or subsidiaries, and in consideration of being allowed to participate said purchaser/tour participant (the "Participant") understands, acknowledges represents, warrants and agrees as follows, with the knowledge that the Company will rely on same:
1. Participant desires to participate in the food tours and culinary events offered by the Company (the "Activities").
2. Participant fully comprehends and accepts all of the risks associated with his/her participation in the Activities including, without limitation, exposure to unfavorable weather conditions, food sickness, injuries (e.g., without limitation, those arising out of self-inflicted accidents or mishaps, other participants, automobiles, pedestrians and the like) and death.
3. Participant is in good health and suffers from no minor or serious physical or mental injury, illness or disability that would make Participant especially susceptible to injury or disability while performing any activity contemplated by this Waiver and Release of Claims.
4. Participant grants to Company and Company's assigns the irrevocable, sub-licensable right and authority to use Participant's name, likeness, photograph and/or picture for any and all commercial or non-commercial purposes now known or later developed in perpetuity throughout the universe without further obligation or compensation to Participant.
PARTICIPANT'S PARTICIPATION IN THE ACTIVITIES IS AT PARTICIPANT'S OWN SOLE RISK. PARTICIPANT, ON BEHALF OF HIS/HERSELF AND/OR ANY PERSON OR ENTITY ACTING THROUGH OR ON BEHALF OF PARTICIPANT, HEREBY FOREVER AND UNCONDITIONALLY RELEASES THE COMPANY, AND ANY AFFILIATED ENTITIES, PARENT COMPANIES, SUBSIDIARIES, PRESENT AND FORMER EMPLOYEES, OWNERS, OFFICERS, MEMBERS, MANAGERS, PARTNERS, CONTRACTORS, INSURERS, SHAREHOLDERS AND DIRECTORS FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LIABILITIES, LOSSES, COSTS AND EXPENSES IN ANY WAY ARISING OUT OF, OR RESULTING FROM, PARTICIPANT'S PARTICIPATION IN THE TOURS, INCLUDING, WITHOUT LIMITATION, ANY AND ALL CLAIMS, ACTIONS, AND LIABILITIES FOR DEATH, INJURY, LOSS OR DAMAGE TO PARTICIPANT, TO ANY ONE ELSE, OR TO ANY PROPERTY, REGARDLESS OF WHETHER OR NOT SUCH INJURY, LOSS OR DAMAGE WAS CAUSED BY THE NEGLIGENCE OR WILLFUL CONDUCT OF THE COMPANY OR ANY OF THE RELEASED PARTIES. PARTICIPANT, ON BEHALF OF HIS/HERSELF AND/OR ANY PERSON OR ENTITY ACTING THROUGH OR ON BEHALF OF PARTICIPANT, FURTHER AGREES TO DEFEND AND INDEMNIFY THE RELEASED PARTIES, AND TO HOLD THE RELEASED PARTIES HARMLESS, FROM ANY AND ALL LIABILITIES, CLAIMS, ACTIONS, DAMAGES, EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEY'S FEES) AND LOSSES OF ANY KIND OR NATURE WHATSOEVER IN ANY WAY ARISING OUT OF, OR RESULTING FROM, PARTICIPANT'S PARTICIPATION IN THE ACTIVITIES.
By participating in an event or activity, I hereby grant Wow events designs (W.E.D) as well as, its directors, officers, employees, agents, and designees revocable permission to capture my image and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “Images”). I further grant permission to copyright, display, publish, distribute, use, modify, print and reprint such Images in any manner whatsoever related to business, including without limitation, publications, advertisements, brochures, web site images, or other electronic displays and transmissions thereof. I further waive any right to inspect or approve the use of the Image by W.E.D prior to its use. I release and hold W.E.D harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the Images, including without limitation, claims for invasion of privacy rights or publicity.
Release of Claims:
Participant hereby releases the Company from any and all liability or claims which may arise from participation in the Events. This paragraph shall be inclusive of, but not limited to, any injury or death resulting from exposure to food or beverage allergies, food borne illnesses, theft of or damage to Participants property, transportation or commute, exposure to adverse weather conditions, or choking. Participant, on behalf of Participant and Participant’s successors, agents or assigns, hereby forever and unconditionally releases the Company, its owners, officers, employees, agents, successors in interest and insurers (hereinafter referred to as the “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses, including, without limitation, attorney’s fees, in any way arising out of, or resulting from, Participant’s participation in the Events. Participant further acknowledges that Company is in no way liable for any injury to resulting from Participant’s own conduct or behavior.
Medical Expenses and Consent to Medical Treatment. Participant hereby accepts full financial responsibility for any personal medical expenses or treatment which may result from participation in the Events, and hereby releases the Company in full from any potential claim for such medical expenses. Further, Participant hereby authorizes the Company to provide Participant with medical treatment, whether resulting from an emergency or otherwise, and hereby releases Company from any and actions in tort for the provision of such medical attention. Nothing in this Paragraph 4 shall be construed to create an actual or implied duty upon Company to provide or seek such medical treatment for Participant.
Participant agrees to pay any and all costs, fees, expenses and charges arising from any act or conduct of Participant that results in damage or injury to any person, including, but not limited to, any third party participant of the Events or employee of the Company. Participant further agrees to indemnify and hold Company harmless from and against any such act or conduct which results in damages of any kind.
The Company hereby reserves the right to cancel the Event(s) for any reason. Additionally, in the instance that the Event(s)have commenced, the Company may cancel the remainder of such Event(s) if, in the opinion of any employee or agent of the Company, there is sufficient reason to believe that Participants may be in danger of injury or loss. This paragraph includes, but is not limited to, any act of God or unforeseeable event, such as natural disasters, riots, acts of governing authorities, or otherwise. In the event of cancellation of the Event(s), the Company shall refund the monies paid by Participant for the ticket(s) within thirty (30) days of such cancellation.
Participants twenty-one (21) years of age and older are able to drink alcohol during designated stops on the Event(s)should they choose to do so. However, alcohol consumption shall be at Participant’s own discretion, risk and liability. Participant may be required to produce government-issued photo identification prior to the commencement of any Event(s) if he or she wishes to partake in any alcohol during the Event(s) The foregoing portion of this Paragraph notwithstanding, the Company reserves the right to excuse any Participant from any Event(s) if said Participant becomes inebriated and misbehaves or has the potential to cause harm to him or herself or any other person or persons. If a Participant is excused from the Events pursuant to this paragraph, it shall be without any sort of reimbursement by Company. All Participants hereby assume all risk involved with the consumption of alcohol and unconditionally hold the Company harmless.
The provisions of this Agreement can only be modified by a written instrument executed by an authorized agent of the Company.
This Agreement constitutes the entire agreement and understanding between Participant and the Company, and cancels, terminates and supersedes any prior agreement or understanding relating to the subject matter hereof. There are no representations, promises, agreements, warranties, covenants, or undertakings other than those contained in this Agreement.
If any part of this Agreement is found to be void by a court of law, the remaining provisions of this Agreement shall nevertheless be binding with the same effect as though the void portions were deleted.
Governing Law and Arbitration:
The construction and meaning of the terms and provisions of this Agreement shall be interpreted in accordance with the laws of the Florida. Any dispute arising out of or relating to this Agreement, including without limitation, the validity, interpretation, performance, or breach thereof, shall be settled by arbitration in Broward county, Florida. Judgment upon any award rendered may be entered before an appropriate court in that country of venue.
Participant acknowledges that this Agreement shall be binding upon Participant’s heirs and assigns, personal representatives, beneficiaries and next of kin.
Participant acknowledges that he or she has carefully read this Agreement and submits to all of the foregoing provisions. Further, Participant acknowledges that he or she enters into this Agreement under his or her own volition, and that Participant has been afforded the opportunity to review this Agreement with the attorney of his or her own choosing. Participant acknowledges that he or she is giving up substantial rights by agreeing to the provisions of this Agreement. This tour is only for participants OVER the age of 21 years.
This welcome tasting is not to be missed so book flights early enough to get in for no later than a 1pm arrival into Montego Bay. You will be picked up at your hotel and whisked to a stunning location on the cliffs away from the chaos and crowds. There you will have a signature drink while you enjoy the spectacular Negril sunset. Once the sun sets you will indulge in a 6 course tasting menu that will stimulate the senses. You will leave this tasting satisfied and inspired.
