Not included: International air arrangements, travel insurance, sightseeing/admissions when not with an expert guide, ground transportation, meals and gratuities are not included unless specified in the itinerary. Please budget for any additional meals, alcoholic beverages, and additional expenses while on your trip. 

A non-refundable deposit of $800 USD is due for all travelers. A second payment of $800 is due January 1, 2018 if not paid in full with the final balance payment required by March 1, 2018. The travel agency has provided a hard due date for any installment payments, so please add these dates to your calendar.  

A reminder will be emailed and texted one-week before each due date to ensure that your payment is processed and your spot remains secure. Heritage Tours (USA) Inc. d/b/a “Heritage Tours” and “Heritage Tours Private Travel” and The J. Diaz Co. d/b/a "Love/Jasmine Diaz" reserves the right to cancel reservations if payments are not paid when due. Non-payment by the due date will result in a forfeiture of any monies paid.

Should something arise and you are unable to make a payment on the due date for reasons that are beyond your control, please contact us immediately at xo@lovebyjd.com. We will do our best to accommodate you, but again, the travel agency has provided a hard due date, so there may not be flexibility.

INSURANCE: We strongly recommend that you purchase a comprehensive travel insurance package including cancellation/interruption and emergency medical evacuation. You may contact us to learn more or purchase a plan.

PLEASE READ TERMS AND CONDITIONS CAREFULLY

RESERVATIONS AND PAYMENT: Each participant must complete a Reservation Application Form and Agreement (hereinafter “Agreement”) and return it with a non-refundable deposit of $800 per person. All items are subject to availability. The balance of payment is due 90 days prior to departure. 

Heritage Tours (USA) Inc. d/b/a “Heritage Tours” and “Heritage Tours Private Travel” and The J. Diaz Co. d/b/a "Love/Jasmine Diaz" reserves the right to cancel reservations if payments are not paid when due. No one will be allowed to depart on a trip unless all payments and necessary documents have been received by Heritage Tours Private Travel. Participants are responsible for bringing a passport with six months remaining validity from the date of your return and, if required, appropriate and valid visas. Participants are responsible for consulting their doctors regarding any medical precautions.

CANCELLATION/REFUNDS: Deposits are fully non-refundable. Payments for air may or may not be refundable. After final payment, refunds of your land portion are computed as follows based on date of receipt of written cancellation notice:

Air tickets are not issued by Heritage Tours Private Travel. They may be non-refundable and may carry substantial penalties for changes or loss of tickets. In certain circumstances (including but not limited to, scheduled and chartered flights and boats, event / party venues, villa rentals, exclusive property buyouts and certain hotels) additional payment may be required with your deposit or in advance of your final payment. Payment for these items may not be refundable and we reserve the right to charge cancellation fees beyond those listed on this Agreement. We will do our best to advise you of any additional payments and cancellation fees.

All changes are subject to a change fee. Tour costs do not include items not clearly specified in the itinerary. Although Heritage Tours Private Travel will make every effort to adhere to this itinerary, on rare occasion it may be necessary to adjust arrangements. Should such adjustment be necessary, substitution will be made to the best of its ability and no refund will be made. Vehicles (including but not limited to automobiles, vans, buses, boats, bicycles, and aircraft of all sizes) used for transport will be the best available depending upon circumstances at time of tour operation. Vehicles are not owned by Heritage Tours Private Travel. Insurance provided with self-drive vehicles may be basic and not comprehensive.

This trip requires a minimum number of ten participants to proceed. Should we fail to meet this number, it may be cancelled or rescheduled, at which point you will be refunded any monies paid minus the non-refundable deposit.

Additional Terms and Conditions

ASSUMPTION OF RISK: YOU ACKNOWLEDGE THAT THE ENJOYMENT AND EXCITEMENT OF TRAVEL TO THE COUNTRIES VISITED DURING THIS TRIP ARE DERIVED IN PART FROM THE INHERENT RISKS INCURRED BY TRAVEL AND ACTIVITY BEYOND THE SAFETY OF LIFE AT HOME OR WORK. YOU ACCEPT THAT AIR TRAVEL TO, FROM AND WITHIN THE COUNTRY(IES) TO WHICH YOU ARE TRAVELING, ESPECIALLY CHARTER FLIGHTS OR FLIGHTS ON SMALL PLANES, AND OTHER MEANS OF TRANSPORTATION ON GROUND OR WATER CARRY A RISK TO HEALTH AND LIFE.

LIMITATION OF LIABILITY: By booking a reservation, you hereby assume any and all risks associated with travel arranged by Heritage Tours Private Travel, including but not limited to those enumerated in the paragraph entitled “Assumption of Risk” above. You agree that you, your heirs, legal representatives and/or family members will not make a claim against or sue Heritage Tours Private Travel or The J. Diaz Co. for loss or injury arising out of such risks.

You understand that HERITAGE TOURS PRIVATE TRAVEL ACTS SOLELY AS A BOOKING SERVICE for hotels, airlines/charter companies, ground transportation (cars, minivans and buses), water transportation, restaurants and/or other services and DOES NOT VOUCH FOR THEIR PRACTICES OR SAFETY MEASURES. Each of these companies is an independent entity with its own management and is not subject to the control of Heritage Tours Private Travel or The J. Diaz Co. You agree that Heritage Tours Private Travel and The J. Diaz Co. shall not be liable for, and you hereby release and hold Heritage Tours Private Travel and The J. Diaz Co. harmless from, any delay, inconve­nience, expense, illness, injury or death or damage to property occasioned through the negligence or default of any company or individual engaged in providing these services.

By booking a reservation, you agree that Heritage Tours Private Travel and The J. Diaz Co. shall not be responsible for, and you hereby release and hold Heritage Tours Private Travel  and The J. Diaz Co. harmless from, additional expenses due to delay or any other loss or injury caused by: weather; force majeure; war or civil unrest; terrorism; criminal acts; roads, trails, hotels or passenger conveyance of any kind; accident or illness; lack of access to means of rapid evacuation or availability of medical supplies; the adequacy of medical attention once provided; physical exertion for which you are not pre­pared; consumption of alcoholic beverages or drugs by persons not employees of Heritage Tours Private Travel and The J. Diaz Co.; expenses incurred prior to, en route to or following a trip; or other causes beyond the reasonable control of Heritage Tours Private Travel and The J. Diaz Co.. You further agree that Heritage Tours Private Travel and The J. Diaz Co. shall not be responsible for incidental or consequential damages of any kind.

Any reference herein to the limitation of liability of Heritage Tours Private Travel and The J. Diaz Co. extends to its owners, officers, employees, agents, servants and representatives.

For any reason, should you change the trip dates or destination after you have paid your deposit and/or final payment and you have completed this Agreement, this Agreement will be fully valid for the new dates and destinations of your trip.

If any portion of this Agreement is unenforceable, the remaining portions shall remain in full force and effect. This Agreement sets forth the entire Agreement of the parties and may only be changed or provisions waived by a writing signed by both parties. This agreement shall be construed, enforced and governed according to the laws of the State of New York appli­cable to agreements made and to be performed in New York.

By booking a reservation, you acknowledge that you have carefully read and understand the contents of this Agreement and agree to its terms.
